The contract for the hire of a vehicle is governed by the conditions contained therein, cancelling all previous conditions. sodadetour reserves the right to amend these general conditions without prior notice. sodadetour (referred to as the “Lessor”) rents to the CUSTOMER (referred to as the “Lessee”) under the terms and conditions specified in the rental agreement, which the CUSTOMER takes note of, agrees to and, by signing it, undertakes to observe and respect.

INFORMATION

The rental terms and conditions are printed on the back of each contract. Please read them carefully.

MINIMUM HIRE PERIOD

The minimum hire period is one day (24 hours) and is limited to 1500 Km/month (plus 1.25€ for each extra km). Special conditions require written approval.

DRIVER

When hiring a car, the driver must present a valid driving licence, identity card or passport and VAT number. To hire a car, the minimum age is 21, with 1 year’s driving experience, for the Economy group; 25, with 3 years’ driving experience for the other groups.

Drivers aged between 19 and 24 or over 65 will be charged an additional rental supplement.

DELIVERY AND RETURN OF THE VEHICLE

Delivery and return of the vehicle will take place at the company’s premises. The customer also has the opportunity to deliver or collect their vehicle at the airport, harbour or hotel, at an additional cost. If it is delivered to another location that is not stipulated, and whenever the distance from the location justifies it, an extra fee will be charged for this service.  If the customer wishes to have their vehicle delivered between 8pm and 8am, an additional charge will be made for the out-of-hours service. These costs are included in the final price of the website, as long as the respective pick-up and/or return times and locations are selected. In occasional cases, sodadetour may give the customer a car similar to the one rented or from a higher group. The vehicle to be hired will be inspected on delivery and collection by a sodadetour employee and the customer. When the car is returned, and after the inspection, if any defects are detected in the vehicle (knocks, scratches), its operation, or the lack of any accessory, which are not due to accidents covered by insurance, the customer will be charged. If the customer wishes to extend the hire of the vehicle, they must notify sodadetour at least 24 hours in advance. This extension will always be subject to approval by sodadetour. In the event of early return of the vehicle, sodadetour will not make any kind of refund.

sodadetour’s office hours are Monday to Sunday from 9:00 to 13:00 and 15:00 to 19:00. At airports we deliver from Monday to Sunday at any flight time, after validation by the reservations centre.

PAYMENT TERMS

The estimated cost of hiring a car will be paid at the time of booking. Valid credit cards are accepted: Visa and Master Card. The credit card holder must be present when the vehicle is collected and a deposit of 22,000 escudos will be charged in the event of damage to the vehicle.

COVER & LIABILITY

Prices include Limited Liability Insurance (luggage excluded) and fire. Prices may include cover for damage caused by accident, total or partial theft of the vehicle, within the

limit of the excess, to be taken out at the beginning of the booking/rental of the vehicle.

sodadetour is not responsible for the following damage to the vehicle:

Damage to tyres, punctures, burst tyres, rims, glass, mirrors, tools, vehicle interior, underside of the vehicle, damage to the clutch or damage caused due to a mistake in the fuel that is filled up. It will always be the driver’s responsibility to pay for any such damage.  sodadetour is not responsible for any fines or legal costs arising from road traffic offences for which the driver is responsible during the car hire period, which will be charged / forwarded to the driver or the company / customer who arranged the car hire, plus €35 per fine / offence for administrative costs.

EXCESSES AND EXCESS REDUCTIONS

Upon collection of the vehicle, a security deposit (excess) will be required on a credit or debit card (sodadetour reserves the right to approve this), the value of which is 22,000 cve, to guarantee costs inherent in possible damage caused or suffered to the rental vehicle, passing through automatic toll gantries, car parks, fines or others. Once you have verified that there are no damages or costs, such as fines or others, inherent to your hire agreement, the excess deposit will be refunded by the same means (credit or debit card).

ADDITIONAL CHARGES

In the event of an accident, sodadetour reserves the right to charge the customer for the cost of repairing the damage caused whenever:

There is misuse of the rented vehicle by the customer, not in accordance with the previously agreed conditions;

The customer does not send sodadetour the duly completed accident report (“Friendly Accident Statement” or “Claim Report”) within the previously established deadlines;

The damage caused to the vehicle is the result of the customer not having correctly assessed the height of the vehicle.

The damage caused results in the vehicle being immobilised. sodadetour reserves the right to demand compensation from the customer, taking into account the number of days needed to repair the vehicle.

At the end of the rental period, the customer agrees that sodadetour will collect the charges for the following situations using the available means of payment (namely credit card or deposit):

Whenever the vehicle is found to be unfit when returned, requiring an extra cleaning service, a supplement of up to a maximum of €160 will be charged.

In all situations where there are charges due to the immobilisation of the vehicle as a result of the customer’s actions, namely, loss or theft of documents or keys to the vehicle; delivery of documents/keys to a station other than the station where the vehicle is due to be returned, or any other situation where the vehicle is immobilised, the customer must compensate sodadetour up to a maximum of €250.

Whenever the vehicle has to be towed as a result of improper action by the customer, the customer is responsible for the cost of transporting the vehicle.

Any costs caused by damage to the rims, tyres, windows, mirrors, tools, interior of the vehicle, underside of the vehicle, damage to the clutch or damage caused by a mistake in the fuel being filled.

The costs of tolls, ex-scuts, fines, traffic offences, regulations and other infractions of the laws in force during the period of the contract with sodadetour are the responsibility of the customer.

For kilometres exceeded in accordance with the general conditions.

BREAKDOWNS AND ACCIDENTS

All vehicles are delivered in perfect working order, equipped with all accessories and showing no apparent defects. In the event of a breakdown or accident, the customer undertakes to inform sodadetour by telephone within a maximum of 24 hours, so that the sodadetour team can advise the customer and monitor the entire process. If necessary, the customer is advised to call Travel Assistance and/or the police.

FUEL POLICY

Fuel is not included in the rental price. The customer undertakes to return the vehicle with the same fuel level as at the time of delivery, and will be charged a refuelling fee and the difference confirmed by the parties when collecting the car.

Returning the vehicle with a fuel level higher than the one at the time of delivery is the customer’s option and responsibility.

Full/empty option

If the customer opts for this promotion, for logistical reasons, they must accept it within 24 hours of the date scheduled for delivery of the vehicle.

Payment for the fuel tank will be made on delivery of the vehicle, in accordance with the price set on the fuel market (on the date of delivery, multiplying the price approved by the ISP by the maximum capacity of the fuel tank of the vehicle booked).

By opting for this promotion, the customer waives reimbursement for the fuel in the vehicle at the time of return.

This promotion is run by sodadetour to safeguard the interests of customers, providing a service that is tailored to their needs, easier, simpler and more convenient, with advantages in time and price savings for both parties.

Note: For rentals of 6 days or more, the purchase of a fuel tank (full/empty option) is compulsory for the economy group. 

Baby seat <13kg – In order to transport a child in a vehicle, it is necessary to have a baby seat according to the child’s age or height. sodadetour can equip the vehicle with the right baby seat for the child. This seat is suitable for children weighing less than 13kg and aged less than 12 months. There will be a daily charge for the equipment of a maximum of €50 per hire.

Baby seat 9-18 kg – This seat is suitable for children weighing between 9 and 18 kg and aged over 12 months. There will be a daily charge of a maximum of €50 per hire.

Baby seat 15-36 kg – This seat is suitable for children weighing between 15 and 36 kg. There will be a daily charge of a maximum of €50 per hire.

Seat / booster 15-36 kg – This seat is suitable for children weighing between 15 and 36 kg. This seat only has a seat and is suitable for children under the age of 12 or with a height of less than 150 cm. There will be a daily charge for the equipment of a maximum of €50 per hire.

Luggage transfer – With the luggage transfer service, sodadetour aims to provide all its customers with greater comfort and autonomy in their choice of car, without luggage being a problem or a limitation. If your luggage doesn’t fit in the car you want to hire, sodadetour offers a complementary service which consists of transporting your luggage from the pick-up point to your desired destination.

ONLINE BOOKING REQUEST CONFIRMATION

On completion of an online booking request, the customer will immediately receive an e-mail confirming receipt of the booking. All bookings will be confirmed within a maximum of 72 hours, either by e-mail or telephone. If the requested car hire is not available, sodadetour may suggest changes to the booking request. The booking is only confirmed once it has been properly collected.

CANCELLATION / CHANGES OF BOOKINGS

Once the car reservation has been made, the following cancellation and reservation change charges will apply:

Changes to reservations after the initial booking will incur a cost of €25;

Cancellations of reservations up to 30 days before the start of a vehicle rental will be charged €50;

Cancellations of reservations between 29 and 15 days before the start of the car rental will be charged 50% of the total reservation value;

Cancellations of reservations between 14 and 1 day before the start of the vehicle rental and no-show will be charged 100% of the total reservation amount;

In exceptional cases (e.g.: vehicle collection outside the national territory) additional costs may be charged to the customer, in addition to the normal cancellation charges.

After the start of the Rental contract, if the Customer decides to terminate the Contract early, the amount corresponding to the days in which they did not use the vehicle (taxes included) will be fully retained as compensation.

Likewise, if sodadetour decides to end the rental before the date indicated in the Contract, the Customer will be entitled to receive from sodadetour double the amounts paid corresponding to the days in which they did not use the vehicle (taxes included), as compensation.
