By using the Sodadetour website to sell your experiences, you accept these Sodadetour Host Terms.

Sodadetour, doing business as “Sodadetour” or “Sodadetour” (also referred to below as “we”, “us” and “our”), operates www.sodadetour.com (a “website”, “site”, “platform”) for you to market and sell your adventure holidays with local guides (“Service”). These Host Terms (“Terms”) govern the agreements between us and you; the individuals, companies and/or organisations (“supplier”, “host”, “guide”, “tour operator”, “you”, “your”) who use the Site and Services for commercial purposes.

Submitting any information to the Site, having an account and receiving enquiries or bookings, or sending a reply to a Customer signifies acceptance of these Terms. By accepting these Terms, you confirm that you are authorised to do so on behalf of your company or any entity you represent.

Other definitions

“Customer”, “Guest” or “Enquirer” means a person(s) who uses this Site, views information, makes enquiries or books a Trip provided by you.

“Trip”, “Trips” means any tour, travel organisation, accommodation, facilities, meals, entertainment, activities, equipment and other services listed on our platform.

“Information” refers to images, videos, text, data and any other media used for profiles, listings, newsletters, guides, blogs, advertising, shop, sponsorship and/or any other information provided by you to us.

Our service

We act as a platform for you, as a local adventure travel guide or tour operator, to market and sell your adventure trips. We are a booking agent and cannot be held responsible for the accuracy of the information you provide on our platform or the quality of your trips.

Hosting on Sodadetour

To become a Sodadetour host, you first need to sign up using our website. We have strict criteria for assessing hosts and you will need to meet all of these criteria. We reserve the right not to accept any Host on the platform for any reason. Once accepted onto the platform, you will have access to a Host dashboard where you will manage your trips.

Your Customer Terms

When a customer books a trip on the Sodadetour platform, they agree to our Booking Terms as well as the standard customer terms and conditions. It is your responsibility to make your terms and conditions available to Customers. Where our Booking Terms and yours differ, your Customer terms and conditions will take precedence, except with regard to our Customer cancellation terms or any terms that your Customer terms do not cover.

Selling your trips

When you become a Sodadetour Host, you will have access to the Site, where you can create and edit your Trips. You will also be able to set and update the price you receive for each Trip (the “Host Price”) and the availability for your Trips. You may adjust this price as you see fit, subject to any additional agreements we may have in place. The price a Customer pays (the “Guest Price”) will differ from the Host Price, allowing for our variable commission rate (“Commission”).

Commission

The standard Commission rate is 20% for Hosts. You agree that we may adjust the Commission as we see fit for reasons including, but not limited to, sale prices, customer discounts, customer credit charges, cancellations and to allow for differences in exchange rates. You agree to authorise us to receive payments from you on your behalf, as your agent, and to deduct our Commission directly from those payments. You will then receive the Host Amount that you set, or that we set in accordance with your instructions, subject to the remainder of this agreement.

Sales tax and VAT

All fees and commissions exclude VAT or sales tax, unless otherwise stated. It is your responsibility to fulfil all relevant tax requirements.

Deposits

You agree that we may offer Clients the option of paying a deposit first and paying the balance later. Under these conditions, our Commission will be deducted first, unless otherwise stated.

Payments

 Once a client has completed their trip with you, the host amount will be scheduled to be paid into the nominated bank account within 40 calendar days, subject to the remainder of this agreement. You agree that we are not liable for any fees or charges from your bank as a result of these payments.

Cancellations

You agree to adopt our standard cancellation terms and conditions for any client who books a trip through us as their agent. You can view the latest version of these customer booking terms.

If a client cancels their trip two months or more before the start date of the trip, you will not receive any Host Value payment. If a customer cancels within 2 months (less a 7-day grace period) of their trip, you will normally receive the full Host Value, unless an alternative agreement is reached between Sodadetour and the host. You agree that Sodadetour may offer date changes, adjustments, refunds or cancellations to customers for their bookings with you outside of these standard terms when, in its sole discretion, it deems it necessary to do so.

Refunds and cancellations

If you cancel the Trip (for whatever reason), or if the Trip is materially different from the way described, you may request a partial or full refund, or dispute a payment using, for example, a chargeback scheme.  We will analyse any request and require a response from you within 5 working days if this happens. Where we have received payments as your agent, you agree that we have the authority to act as arbitrator of such disputes and issue any refunds or accept disputed card payments on your behalf.

In the event that a full refund is processed for a customer following cancellation by the Host for any reason, or if a chargeback is received in relation to a booking, the Host will remain liable to pay the Commission due to Sodadetour; as this amount cannot be deducted directly from the Guest Price paid by the Customer in this case. Sodadetour may invoice the Host separately for the Commission or adjust future payments to the Host to collect the Commission due.

Chargebacks may be received in relation to a Customer booking at any time. In the event that a chargeback is received after a trip has taken place, the Host Value will no longer be due to the Host and the Host will be liable for the amount of the chargeback. If a trip has not yet taken place, the booking relating to the chargeback will be cancelled and the Host will no longer be eligible to receive the Host Value.

Sodadetour reserves the right to pass on any fees related to the chargeback to the Host when Sodadetour, at its sole discretion, considers that the Client is justified in having created a chargeback or if the Host has acted in any way improperly (which may have resulted in the chargeback). In addition, Sodadetour reserves the right to impose an additional administrative fee (up to the value of the disputed booking or 250 euros – whichever is greater) on the Host for dealing with chargebacks when Sodadetour considers that the Host has acted improperly.

Liability

Suppliers accept all responsibility for their Trips and their Clients and agree that we have no liability. We accept no responsibility for any activity or behaviour of anyone who has used the site, made an enquiry through the site or for any behaviour or activity of people who book and travel with Hosts. We accept no responsibility for any information provided to us by Suppliers for publication on the site. To the extent permitted by applicable law, we accept no liability for any loss caused by omission from the site, typographical errors or late publication or failure from any cause whatsoever, whether error, technical late publication or failure to display listings, advertising and/or sponsorship. In any event, our liability for any loss or damage caused by negligence or otherwise shall be limited to the cost of any listings, advertising and/or sponsorship and we shall not be liable for any consequential loss or damage or loss of profit of the purchaser or any other party, nor shall we be liable for any other loss suffered. You agree to indemnify us against all losses, damages, claims or expenses (including legal costs), which we may reasonably incur, on account of any third party claim arising directly or indirectly from the information provided by you for listings, advertising and/or sponsorship, or from the activities, malpractice or negligence of you, the Supplier. This may include, but is not limited to, claims that any information provided by you, the Supplier, is in any way misleading, inaccurate, defamatory and/or offensive, and any action for breach of contract and/or any tortious action.

Information, Images and Media

Hosts agree that it is their responsibility to submit information and to check that all information is accurate, up to date and complete. You specifically agree that it is your responsibility to ensure the accuracy of price and availability information displayed to Customers about their Trips. You confirm that you will accept bookings for your products and services at the price you most recently submitted to the site by whatever means. It is illegal to provide false or misleading price information. We may use information and images to market your products and services and generate new enquiries from Customers other than just on this website. We always undertake to obtain your prior approval for any new marketing partnerships. However, you agree that all information and images provided to us may be used in other forms of marketing, on other websites owned by us and provided to external websites not owned by us, at our discretion, only when expressly linked to your product, without prior approval. In circumstances where we believe that a piece of information or image may be useful in more general ways, we undertake to obtain your prior approval. Information is accepted on the understanding that any descriptions of goods, services, stock, etc. are accurate and comply with national law. We reserve the right to approve, amend or refuse the copy at our sole discretion and without explanation. We also reserve the right to change the layout of supplier pages, the information displayed and the appearance of the site as we see fit and without prior notice.

Capacity and Availability

Once a trip has been listed on Sodadetour.com, it shall proceed without requiring a minimum number of bookings. Exceptions to this requirement must be granted in writing by Sodadetour.

Exclusivity and Co-selling

We do not require exclusivity for your Trips, which means that you can sell the same Trips on other platforms or directly. You can also sell dates of trips on other platforms or directly, as long as the trip description and guest price are identical.

Privacy protection

When bookings are made, we share the Customer’s personal information with you so that you can finalise the booking. This information may also be shared by e-mail. The information includes names, addresses, contact details and other personal information you may need, including medical and dietary requirements and travel plans. Where the customer is an EU citizen, you must treat this personal information in accordance with the General Data Protection Regulation ((EU) 2016/679) (GDPR) and any implementing legislation (Data Protection Legislation). This includes keeping all the information we share with you confidential, stored securely and only for as long as necessary; and using the data only for the purpose for which it is intended – to manage the booking and provide the services requested. You agree not to contact the customer for any other purpose, unless they subsequently give you explicit and direct consent. You will not share the information with third parties, except where essential for the purposes of managing a booking and providing services. In these circumstances, you require that these third parties also handle the information in accordance with the General Data Protection Regulation ((EU) 2016/679) (GDPR) and any implementing legislation (Data Protection Legislation).

Communication

All communication with your Guests, before and after the trip, must be done via the Sodadetour messaging system. The only exception is if you have an emergency or need to obtain urgent information, in which case you can use the telephone number provided.

You agree not to send any marketing communications to customers who have booked through Sodadetour. This includes links to social media pages (e.g. Facebook pages) or links to your website. 

Termination

Both parties reserve the right to terminate this contract at any time without notice. Any bookings made prior to termination will be honoured by the Host, unless express consent is given by Sodadetour to waive this requirement; the conduct of both parties in relation to these bookings will be regulated in accordance with the terms of this agreement.

How does sodadetour work?

Sodadetour is a booking platform and community for like-minded adventurers. The platform allows travellers to book unique, one-of-a-kind trips with trusted local guides.

Each trip on Sodadetour is managed by a different local guide who manages the trip and receives payment.  The platform also acts as a communication centre between our guests and hosts.

Why book through Sodadetour?

When you book through Sodadetour, you get competitive prices. As we’re not a tour operator, you get unrivalled value with no extras.

It’s a great option for those travelling alone, as we work with our operators to create a standardised pricing system that offers the social advantages of group tours.

How do you select your tour operators?

Sodadetour trips are provided by both the company and third parties and are carried out by small, hand-picked local guiding companies. Each Sodadetour guide meets our gold standard in service, safety and sustainability. We select our tour operators based on personal experience, best practice and excellent service delivery.

Are the trips guaranteed?

Yes, all trips are guaranteed. There’s no need to worry about the trip having to reach a minimum number of bookings to go ahead.

Is my payment secure?

All transactions on our platform are processed securely.

Can I cancel my trip?

Yes, you can reschedule or cancel your trip up to two months in advance and receive Sodadetour credit equal to the deposit paid. Use this lifetime credit towards the deposit of any subsequent Sodadetour trip.

Any balance payments will also be refunded at this time.

What happens if I need to cancel less than two months before the trip?

If there are less than two months before the trip and you need to cancel, please contact us. At this stage, bookings are treated as final, so we cannot offer refunds or date changes.

This is because all our trips have a performance guarantee. Therefore, the local guides have usually already made all the travel arrangements at this time.

In these cases, we recommend contacting your insurance to see if you can claim on your policy.

In some cases, it is also possible to change the name on your booking if you have someone who wants to take your place on the trip. However, this is only at the discretion of the guide.

My booking was cancelled, but I didn’t cancel it and I still want to travel – what happened?

Our system sends automatic payment reminders for you to pay the balance of your trip. The balance is due two months before departure (you will be notified at the time of booking). If you miss these reminders and don’t pay the balance, the system will automatically cancel your booking.

If this happens, please contact us. We can see what happened and see what we can do to get you back on the trip.

How can I cancel/change the dates of my trip?

The easiest way to change dates or cancel a booking is:

– Go to your dashboard: 

– Click on the booking

– Click on CANCEL/CHANGE DATES at the bottom. You will automatically be guided through the process.

Can I cancel a space from my booking?

Yes, you can cancel a space (or more) from your booking. To do so:

– Go to your dashboard:  

– Click on the trip

– Scroll down to the INVOICE section and select CANCEL/CHANGE DATE

– Follow the instructions. You will be asked how many spaces you want to cancel. Select the appropriate number.

Please note that all deposits are non-refundable.

However, if the trip takes longer than two months, part of the deposit will be returned to your panel as credits. These credits do not expire and can be used to deposit any trip on our website.

Is there a waiting list for fully booked trips?

Our most popular trips are often fully booked. If you’ve missed the dates you wanted, you can join the waiting list for a trip.

You can do this for as many trip dates as you like. If someone cancels and a spot becomes available, you will automatically receive an email notification asking if you want to book.

What insurance should I take out?

Unfortunately, we can’t give formal advice on travel insurance, as this is a regulated sector.

What we can say, however, is that many of our clients turn to insurance companies that specialise in adventure travel, for example World Nomads.

If you’re not sure what exactly your trip involves (for example, the highest altitude or similar questions), the best thing to do is to ask your main travel guide.

What are Sodadetour credits and how do they work?

If you cancel a qualifying trip (to change dates or for any other reason), in most cases you will receive a deposit credit on your Sodadetour account.

Credits are cash equivalents that you can use as a deposit payment when booking a trip through sodadetour.

You can only use credits to cover the cost of a travel deposit and not to cover the total balance.

Travel credits are covered by our Lifetime Credit Policy and do not expire. You can use them to cover the cost of any future travel deposit.
