1. The Contract

The contract is between Sodadetour (us) and the Client, including all persons named on the booking form. 

 The person signing the booking form has the power to bind all persons whose names appear on it and agrees to these terms and conditions on their behalf.

2. Prices and surcharges

Sodadetour reserves the right to increase the cost of the tour to take account of the following items: government action, currency fluctuations, transport costs (including the cost of fuel), increases in food, airport taxes and increases in scheduled air fares or any other increase that is beyond our control. All prices are based on euros and Cape Verdean escudos.

 In the event of any price increase, Sodadetour reserves the right to make the necessary adjustment.

3. Deposit required to confirm a booking

A deposit of 30% per person is required to confirm a booking (non-refundable deposit).

All flights (domestic and international) must be paid 100% in advance to guarantee a place.

Full payment is required if the booking is made 60 days or less before departure.

4. Full payment and reconfirmation of booking

The full payment or balance must be paid 60 to 45 days before the departure date of the trip.

As soon as we receive full payment, we will send the client an e-mail confirming the booking.

Full payment is due if the booking is made 60 days or less before departure.

If full payment or the balance is not paid on or before the due date, we reserve the right to consider the booking cancelled.

5. Cancellation by the customer

Any cancellation by a Client must be made in writing and acknowledged by Sodadetour in writing. The date on which the cancellation request is received by Sodadetour or its travel consultants will determine the applicable cancellation fees.

a) Seventy days or more before departure, non-refundable deposit.

b) 69-30 days; we will retain 40% of the cost of the trip.

c) 30-16 days; we will retain 70% of the cost of the trip.

d) We will retain 100% of the cost of a trip of fifteen days or less.

Special notes

Payments or deposits for flight bookings are refundable in accordance with the airline's terms and conditions.

If the trip is postponed, an administration fee of 20% of the cost of the trip will be charged, plus the amount already spent on non-refundable subcontracted services. The remaining amount can be used for future trips with Sodadetour. No refunds will be made if the client voluntarily abandons the trip for any reason after the start of the trip. Refunds will be at Sodadetour's discretion if the customer is involuntarily forced to abandon the trip for any reason. No refunds will be made for unused accommodation, transport, tours, meals or services.

It is highly recommended to take out comprehensive insurance, which includes cover, in certain circumstances, against loss of deposit or cancellation fees.

7. Cancellations and changes by Sodadetour

Sodadetour will do its utmost to operate all tours as described, but by signing this contract, the client understands that changes may be made to the itinerary or items covered on the trip if this is necessary or beneficial in light of the client's current situation.

Unforeseen and extraordinary situations beyond the company's control have had unavoidable effects. 

he company will limit external influences. Political conflicts, border closures, visa refusals, strikes, flight delays, unpredictable weather, strikes, war, civil unrest, natural disasters, government actions, technical problems or fortuitous events are not covered. Sodadetour reserves the right at any time to cancel or alter any of the facilities, services or prices (including flights, accommodation or other arrangements) and substitute with alternative arrangements of comparable monetary value and without monetary compensation or refund of monies; and accepts no liability for loss of enjoyment as a result of such alterations. The client agrees to bear all extra costs arising from these factors.

We are not responsible for unexpected fees incurred due to the customer's bookings, 8. Payment methods

a credit card

We accept VISA, MasterCard, vint24 card; through this payment method we do not charge any commission.

b) Bank transfer

The customer can transfer funds directly to our bank account. The customer needs to add an administration fee of 150€ to the amount sent.

Transfers take between 1 and 3 days, depending on where the transfer is made.

9. Changes by the client

For any itinerary changes made by the customer after obtaining a confirmed travel invoice from Sodadetour, the customer will be charged €40 in addition to any expenses or fees incurred or assessed by our suppliers as a consequence of the change. Whilst every attempt will be made to accommodate revisions and additional requests, we cannot guarantee compliance.

Changes must be made by the client no later than 45 days prior to departure. Otherwise, Sodadetour reserves the right to accept or reject adjustments depending on the availability of accommodation, tour guides and tourist transport.

Changes to bookings made 44 working days before departure will not be accepted.

Any changes to the original booking must be confirmed by the person signing the booking form.

10. Customer replacement

Suppose a member of your group is unable to travel. In this case, it may be possible to transfer the booking to another suitable person, provided written notification is given at least 45 days before departure.

We charge €50 for administrative costs, plus any costs imposed by Sodadetour's suppliers.

11. Medical conditions and special requirements

During the booking process, the client must inform Sodadetour in writing of any medical conditions, pregnancy, disability or other mental and physical problems.

 Failure to notify Sodadetour may result in the customer being refused a trip.

 Failure to inform Sodadetour of such conditions will result in the client being charged the full cost of the cancellation.

 Some journeys may be unsuitable for Customers due to age, mobility, disability, pregnancy or physical or mental conditions. It is the client's responsibility to check this before making a booking. Sodadetour may refuse to transport pregnant women over 24 weeks or Customers with certain conditions. Sodadetour is not obliged to provide exceptional facilities unless you have agreed to do so in writing. Sodadetour will do its best to meet special requests from Customers, including dietary requests, but such requests do not form part of the contract. Sodadetour is therefore not responsible for failing to provide these requests. Medical facilities vary from country to country, and Sodadetour makes no representations or warranties as to the standard of such treatment.

Travelling with children

 Customers aged 18 on the date of their first trip are considered adults. An adult over the age of 18 must not accompany children under the age of 18. The minimum age for Customers travelling on tours is 12 (for tours designated for Families, the minimum age is 5). All enquiries regarding children are subject to analysis and approval by Sodadetour, which reserves the right to restrict the number of travellers under 18 on tours.

12. Passport, visa and vaccinations

The client must carry a valid passport for the duration of the trip to show visa authorisations, vaccinations and preventative medication as required at the excursion site. Sodadetour provides information in good faith, but without liability.

13. Age, physical fitness and participation

Customers must be in good physical condition and health to complete the chosen itinerary. People over 60 must obtain medical proof of fitness to travel on the chosen itinerary.

All passengers under the age of 18 must be accompanied by an adult.

Suppose that customers are not in the minimum physical condition and state of health. In this case, Sodadetour reserves the absolute right to refuse a booking at its discretion.

Suppose that the client's health or behaviour puts safety or the normal development of the itinerary at risk. In this case, Sodadetour may separate the customer from all or part of the tour. In the event of health problems, Sodadetour may take the measures it deems appropriate and recover the costs from the client.

14. Local laws

Everyone who takes part in trips organised by Sodadetour expects to comply with the laws and rules of the country. Any failure to do so will release Sodadetour from all obligations it may have under these booking conditions

15. Illness or disability

Any person with a physical or medical condition requiring medication or special attention while travelling must disclose the fundamental nature of their illness at the time of booking and make appropriate arrangements.

Suppose the customer does not make such a disclosure. In that case, they will be in breach of these booking conditions, resulting in immediate exclusion from the trip and the loss of any payments already made by the customer.

Customers who do not know how to swim must state this fact at the time of booking if the desired holiday involves any excursion or boat transport. Sodadetour will be able to take all necessary precautions for the customer's safety without cancelling the excursion.

16. Travel insurance

Travel insurance is required. Sodadetour strongly recommends travel insurance for all our travellers. Travel insurance should provide cover against personal accidents, death, medical expenses and emergency repatriation with minimum cover. We also strongly recommend that it covers cancellation, curtailment, personal liability, loss of luggage and personal belongings. 

 Clients must present proof of travel insurance 15 days before the departure of the trip.

 Special note

 Suppose customers do not consider travel insurance necessary or do not need it. In this case, they must sign a declaration stating that they do not need travel insurance. The client will be responsible if any inconvenience occurs during the trip.

17. Flight bookings

Sodadetour will do its utmost to ensure that all flight prices are correct at the time of booking. Airlines reserve the right to change or withdraw fares without prior notice.

The price of the airline ticket is confirmed when the flight price is paid in full and the tickets are issued.

Changes to dates, routes, names and so on will be made in accordance with the airlines' terms and conditions.

The customer must check the tickets very carefully immediately after receiving the latest timetables. Sodadetour will endeavour to inform the customer as soon as possible in the event of any flight changes.

Sodadetour is not responsible for flight delays caused by weather conditions, air traffic controllers, airport authorities, (local) governments, airline rescheduling, mechanical failure, strikes or industrial action.

18. Customer responsibility

Clients agree to accept the authority and decisions of Sodadetour's staff, guides, tour leaders and travel consultants during the tour. Suppose these people think that a customer's health or behaviour before or after departure is likely to threaten the safety, comfort or smooth running of the tour. In this case, the customer could be expelled from all or part of the tour.

 In the event of health problems, Sodadetour may take the action it deems appropriate and recover the costs from the customer.

If a customer commits an illegal act, they may be excluded from the tour and Sodadetour will no longer be responsible for them. Suppose the customer is affected by a medical or other condition. In the event that this may affect the enjoyment or active participation of other people on the tour, the client must notify us at the time of booking.

No refunds will be given for any unused services. Clients must have a valid passport to show at checkpoints, and it is their responsibility to obtain a valid passport and a visa if necessary. Any vaccination certificates required for the entire trip.

Information on these matters or related items (weather, clothing, luggage, etc.) is provided in good faith. However, Sodadetour cannot be held responsible for this information.

19. Sodadetour's liability

Sodadetour organises on behalf of our travellers, with their names, transport, accommodation and other necessary tourist services, so we cannot be held responsible in the event of accidents, loss of personal belongings during the outsourcing of services such as: during the services of the Tour Guide, transport, in hotels, in restaurants, during hikes and other delays or interferences in the tour, for the main reasons for which we have no direct responsibility.

Sodadetour cannot be held responsible for illnesses, maternity, or physical or mental impediments that may put the health or integrity of the traveller or third parties at risk during the tour. We will not accept any claims or refunds for the reasons mentioned above.

Sodadetour will not pay any compensation if it is forced to cancel or change the trip due to war, riot, civil conflict, industrial dispute, natural disaster, fire, bad weather, epidemics, health risks, technical transport, maintenance problems, closed or crowded airports or similar events.

Sodadetour cannot be held responsible for changes to flight schedules or departure airports, as this is the responsibility of the airline. However, we will do our best to minimise their effect on your trip. We cannot accept responsibility for any delays to any of your flights, whether the cancellation or delay is caused by adverse weather conditions, airline rescheduling, airport authority and/or air traffic controller action, mechanical breakdown or industrial action. When long flight delays result in lost holidays, no refunds will be granted by hotels or suppliers. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavour to reduce the inconvenience of any delay by providing meals and accommodation as appropriate for the time of day or night (depending on local availability) if you incur payments for such services in the event of a delay.

Sodadetour will not accept liability for payment unless we have given our prior consent. We ask the client to inform us of any limitations of this nature prior to contracting our services in order to recommend special services that take account of the existing impediments.

20. If the Client has a complaint?

Suppose the client has a complaint about any tour organisation. In that case, the customer should take it up with the tour guide or another Sodadetour employee at the time, so that they can make their best efforts to rectify the situation.

 Only if Sodadetour is informed of any problems will there be an opportunity to put things right.

 Complaining to Sodadetour when a problem arises during your trip will allow us to remedy the situation or facilitate compensation. If the problem remains unresolved, a complaint must be made in writing to Sodadetour within 28 days of the end of the holiday. 21. Financial security

Sodadetour is an accredited Tour Operator registered with the tax identification number 269099301 and with the tourist agency licence Nº42/SAL/AT/2023, based in Santa Maria, island of Sal.

22. Photography and testimonials

If we capture or take any images of the client during the tour, we have the right to use them in our advertising campaigns free of charge. We use this material to promote our trips, video shows, brochures and the Internet. If the customer has provided us with any written feedback, this can also be used for promotional purposes.

23. Privacy policy

Sodadetour will use the personal information provided by our clients to make all the travel arrangements. In addition, we will have to pass it on to our suppliers and carriers to enable the operation of the services requested by the client. However, we will do our utmost to protect customer information and use it only for official purposes, which is essential.
